

Google have been served with a lawsuit over a blog on it’s Indian subsidary. Mumbai-based Gremach Infrastructure Equipments & Projects Ltd is demanding Google disclose the name of a person who criticised it on a blog written by a blogger called Toxic Writer.

The court order stated that Google India have four weeks to reveal the identity of the blogger. At this time Google is yet to reveal the blogger’s name.
Should Google loses the case a precedent could be set leading to challenges to the anonymity of blog writers. This will see a fundamental shift in the dynamic of blogging. Companies have long argused that they have no meaningful real right of reply or means of defending themselves if they are attacked anonymously via online blogs. Whilst this open medium is a perfect platform for vigilant whistle blowers it is also an open, unregulated forum that is ripe for slander and defamation.
Gremach are saying they have been subjected to a “hate campaign.” and whilst the blog in question has been taken down they are seeking further legal recourse.
